I'm surprised this is still being talked about, but at least all of you are missing the point of the case. Spose decided for some odd reason not to include Motorolla had a RAND for those codices when trying to inform people. The RAND was in place the entire time the 360 was in development and during the manufacturing of the console. It wasn't until Google owned a good chunk of Motorolla that this case came to be.
The reason why this case occurred was due to Motorolla changing their RAND policy for said codecs. The company decided to charged more for the RAND and only raised the price of the license for a select few, mainly Microsoft. The open contract doesn't allow Motorolla to do that, which is why Microsoft sued Motorolla. They weren't trying to sue Motorolla because of the codec, it was due to the unfair treatment they were getting from the previous agreement. Of course, there was a loophole in the contract that allowed them to change the fees and that is what is being fought over (and also why Motorolla won the initial lawsuit). The possible ban for the console is due to not paying the new fees to use said codices, which will violate the agreement to use the patent. Both parties are dicks, but Motorolla is the true dick in this case.
Like I said though, this will be settled by doing some quick modifying to the codices and/or a little side money to shut them up.

Microsoft has a large record of problems with anti-monopoly laws here in Europe. This case has nothing to do with monopoly abuse but it's clear that respecting other companies and their products is not something Microsoft cares about too much, to the point of breaking the rules as an habit. Good thing the European Commission and the German court have been there to impose some common sense.
Reading threads like this is fun cos some people would say anything to defend Microsoft, even when it's clear they are the ones to blame![]()

And i didn't include the fact that they had a rand because its not important part of the terms when using it in the RAND allows the law-suite. Not to mention it was included in the article you would read that they had a RAND.
And i might as well end this post because the whole point was to prove that i didn't just correct people and not input my opinion as you say Dr. Mario does or whatever.
Or E., I didn't see it as an opinion, just you stating the 'facts'. Also, the RAND is a big deal since the agreement allows everyone to use the codecs, without permission, as long as you pay the fees. Without the RAND, this problem wouldn't be happening. It should be important to mention it when the links to the article don't mention it, at all and shapes the discussion about it. It is easy to tell Microsoft to kick rocks and to bash them when it really isn't a clear cut case of them being the big bad meanies they are claimed to be.

Right now, Sony and Nintendo are the only corporations to have their consoles on foot in the mainland US. Those are made in China and the ones being made in Japan are rare here. Only Microsoft will have their consoles made in China. Look, I'm not an ordinary capitalist, I'm a free market anarchist. $300-600 for a video game console at launch? I'll wait three years for the prices to be lowered and get the black-colored slim version instead. So far, this move from the judge made the industry a joke. I am saying, "I doubt that Barack Obama and the judge to refuse the ban of the Xbox 360s". They're just doing this to prevent debt, but not literally.

In retaliation Clinton sicked the Dept. of Justice on Gates and Microsoft and I am not a fan of Microsoft by any means of the imagination.
Look at what happened with Gibson Guitars with Obama. 'Importing Rare/Illegal Wood To Make Guitars' my ass. The owner was an influential and outspoken Republican and donates to the Republican Party.
Yet they didn't bother with Motorola Solutions (the other half that caters mostly to governmental customers). These lawsuits have been flying back and forth for years. I'll admit that economic and legal shenanigans bore me to sleep, but the larger implications of the games they play is cause for concern. That said--it seems to be business as usual...
