I'm surprised this is still being talked about, but at least all of you are missing the point of the case. Spose decided for some odd reason not to include Motorolla had a RAND for those codices when trying to inform people. The RAND was in place the entire time the 360 was in development and during the manufacturing of the console. It wasn't until Google owned a good chunk of Motorolla that this case came to be.
The reason why this case occurred was due to Motorolla changing their RAND policy for said codecs. The company decided to charged more for the RAND and only raised the price of the license for a select few, mainly Microsoft. The open contract doesn't allow Motorolla to do that, which is why Microsoft sued Motorolla. They weren't trying to sue Motorolla because of the codec, it was due to the unfair treatment they were getting from the previous agreement. Of course, there was a loophole in the contract that allowed them to change the fees and that is what is being fought over (and also why Motorolla won the initial lawsuit). The possible ban for the console is due to not paying the new fees to use said codices, which will violate the agreement to use the patent. Both parties are dicks, but Motorolla is the true dick in this case.
Like I said though, this will be settled by doing some quick modifying to the codices and/or a little side money to shut them up.
