Also, the RAND is a big deal since the agreement allows everyone to use the codecs, without permission, as long as you pay the fees. Without the RAND, this problem wouldn't be happening. It should be important to mention it when the links to the article don't mention it, at all and shapes the discussion about it. It is easy to tell Microsoft to kick rocks and to bash them when it really isn't a clear cut case of them being the big bad meanies they are claimed to be.
