Yeah it's good business, it's keeping them alive. But it would also be good business for them to barge into your property and take what they want. It's profitable, yet not acceptable. I think Nintendo's stance is profitable for them, but not acceptable for me. (or any other human being who's not part of Nintendo)
Nintendo's stance has always been that it's illegal to download an extra copy, but perfectly legal to make an extra copy for yourself. Difficult with cartridge based media, like the NES->N64/GB->3DS, not so difficult with the Wii. While their stance on emulators themselves is archaic and ignores the homebrew scene (and also wouldn't hold up in court), they have to protect their assets, and would not be doing their due diligence to their shareholders if they did not.
