I lost them both in ME1. They were in the ME3 demo, but not the real game, since I imported.
Also, I had a VI of Legion who kept saying "I am not Legion" the whole game

I'm pretty sure they're in the demo regardless, but without import data, almost everyone is missing with the exception of Tali and Garrus.

I lost Jack, Legion, Zaheed, Kasumi and Grunt, as well as all of the crew since I went ahead and did loyalties before the suicide mission. I had 100% loyalty, so I still maintain the deaths of squadmates is fully random.

I believe that the only character who can die outside of no loyalty, and specialty selection is Mordin, ALWAYS SEND HIM BACK TO THE SHIP.
