Yes. And it wasn't the first, EULA isn't held too highly in legal cases (Europe more or less disregards EULA as a legal contract entirely). But circumvention software of any kind goes against the DMCA, so even if the EULA doesn't hold water, they're still going around protection software against the wishes of the creator.
The legal definition of computer is more or less "anything that processes and stores data". Consoles are generally regarded as stripped down PCs that exist for the sole purpose of gaming. PS3s go several steps further by featuring several parts and features that also exist in what most people regard as computers (non legal definition). It has a hard drive and at one point was capable of running a linux based OS about as well as some actual (but limited) PCs. I've posted on this site from my PS3 on a couple occasions. It's not a huge stretch to call it a "computer".I cant see it being classed as a computer, but your right, its a grey area.
Whilst its SCE, PS3 is still marketed as a video game console.

You'd think so, but not really. Because the constitution is a rough guideline that's been changed a lot over the years, and they were rarely clear on the intent of parts of it. And the rights of american citizens are defined more by whatever people state the constitution means this week than what it actually reads (Equality and freedom for all? In America? HA HA HA). The Universal Declaration of Human Rights has about as much say as the American Constitution does.Um, one would think that the constitution would hold some weight? i mean isnt it the legal blue print for your rights as an American?
If I had to guess, I'd wager they probably quoted that bit about "no taxation without representation". It's a favorite of people grasping at straws. And it's completely and utterly irrelevant when we're talking about a corporation that's publicly traded and isn't required to follow the same laws as a government. And a basis for that part of the constitution was to prevent a similar situation from eventually taking root in america as the one that was happening in the colonies (it did anyway, but that's beside the point). The context is completely different than this (demanding money for nothing vs offering a service but putting regulations in place). However they may want to interpret it is up to them, but I'm sure most courts wouldn't think it'd be okay to skip out on paying taxes because you didn't think your government was looking out for you. It doesn't matter how you quote it, unless the constitution clearly stated that something was wrong, you'd have a hard time using it as a basis for anything. And even if it did, nobody really has to follow it.
Your knowledge is extensive Raype. I fully agree with you, when I play games on consoles and I get shitty framerates and poor textures I'm glad there are PC ports that I can play instead. The Wii is a fancy Gamecube and the other two are way behind top end computer specs. Consoles are definitely not computers and fall way behind PCs in specs so they are toys for kids.
