    When it comes to pirating?

    I use... "trials".

    Give it a try out of curiosity, if its good, save up and buy it, if not, deletion is in order.

    I get a better feeling when I buy games, because I feel like artists deserve money for their work if they've made it well, and I'm happy to give it to them as thanks. I like to donate to independent developers as well.

    One of the basis for his hack was that you could alter the online play.

    He even condoned people hacking games.

    Most law suits filed dont go to the 9th circuit, most of the cases are "won" purely because major company > Small time person.
    The likes of Nintendo/Sony/Xbox, have money to waste, the costs to get a case reviewed by the 9th is insane, nothing a normal person could afford.

    I tend to pirate nearly everything unless it's good. I frequently buy games because they tend to be worth the cost even if they aren't exceptional. But even then, I do have a sizable collection of pirated material.

    But still, plastering your face all over the internet begging to be sued and then asking for money to fight the lawsuit you were clearly begging to get just seems so very, very stupid. Now if you'll excuse me, I'm gonna go mail a copy of a video where I torrent a bunch of movies to hollywood. But not because I'm an attention whore, I'm just being informative!

    You mean third circuit. He's on the east coast. It's outside their jurisdiction.

    Blizzard v MDY for instance. Which is essentially what this is. Or the TPB rulings for something a little more recent. In the case of the latter, they weren't charged with file sharing, they were charged with allowing it to happen and creating a method to go about doing that. GH has made no secret of the fact he's trying to impede on sony's business. Since the PS3 is legally a personal computer (murky legal definitions ahoy) and it's involved with international commerce via PSN (which functions as a limited bank), he's participating in a conspiracy to commit international fraud. The DMCA makes this like shooting fish in a barrel, since it exists more or less to make what he did a legal offense.

    Nope, there's districts. The 9th is the largest and covers a huge chunk of western america (California falls within it). It's also the worst district for GH's legal team since it cracks down hard on piracy. Sony has been trying for a change of venue to the 9th because of that. They've been keeping things within GH's state last I checked.

    So far no appeal on BvG has denied the DMCA ruling though. Because the DMCA clearly defines that circumvention is wrong aside from certain special cases. The PS3 hack is a clear circumvention method to go around a EULA and anti-piracy measures. Therefore, it falls within DMCA and I'd be shocked if they manage to fuck up such a clear cut case. I cannot see him beating that charge, since people never walk away from it.

    No, they define it as a computer. In europe they did it actively to bypass some trade laws. Sony COMPUTER Entertainment and all that. And, like I said, the legal definition of "computer" is murky at best (most phones and some calculators can be classified as computers if you try hard enough).

But there were alternative reasons for hacking the PSP FW, and Dark Alex was smart enough to cover his ass a bit (his primary reason for hacking the PSP was allowing for homebrew applications, supposedly. GH was more "PS3's hacked, pirate games now. LOLSONY".). That, and he didn't plaster his face everywhere and ask to be sued. But due to the way things went with the PSP afterwards, Sony probably would've pursued it had the same thing happened today. Time will tell when the inevitable NGP hacks appear.

    Possibly, but I don't see how it'd even matter. The constitution rarely holds up in court, since it's very much open to personal interpretation in a lot of ways. Especially since this sort of thing didn't go on way back when. You might as well be quoting the bible, unless the judge and/or jury gets all teary eyed.

    Wasnt there a ruling in the BvG case that confirmed the EULA wasnt a legaly binding contract?

    Whilst its SCE, PS3 is still marketed as a video game console.
