Default Determining Legitmacy of and Troubleshooting European Copy of Phantom Hourglass

I've recently purchased a European copy of The Legend of Zelda: Phantom Hourglass from a seller on eBay. I know there are a lot of counterfeits on eBay, and I would like to do what I can to ensure that this isn't one. The cartdrige looks legitimate, but I haven't had a lot of experience with DS carts. (Note: I primariliy used this guide as reference: http://www.wikihow.com/Determine-if-...S-Game-Is-Fake )

There are two things that concern me:
    1. The game seems to only be detected about half the time I try to start it. (Using a Nintendo DS Lite [C/USG-USA-1])
    2. When I save, I seem to lose progress to a certain point. E.g. When I'm in a dungeon and save then load, the dungeon resets but my map markings stay (Currently in the temple on the Isle of Ember). This also occurred on a larger scale: When I saved in the Ocean King's temple before saving Linebeck and saved and reset the game, I loaded back in the village and had to go to Linebeck's ship and talk to the bartender before I could leave the village (due to the fairy not allowing you to leave until you've asked about Linebeck).

Any assistance on this would be appreciated.
