There is basically ZERO risk downloading something from a direct connection to a download server. The only parties that would be aware you did anything, is the server (they're obviously not going to rat you), and your ISP (which shouldn't care how you're using your connection).
The only point you'll be in any sort of risk downloading, is when you're using p2p. By the nature of p2p, you're connecting to anybody and everybody possible. It's easy for any rights holders to observe those connections, and complain at your IP. Which does basically nothing, your ISP will tell you to knock it off.
*PSA* Wii Redump collector's can now unscrub ISO files. So scrubbed games can now be verified. You can find the program to do this here
Depending where you are ISPs can be required by law to be proactive about detecting copyright infringement (among other things such as child pornography).

Yeah. There's that. Also if you're downloading crazy illegal shit the server you're getting stuff from could be a honeypot too But these things shouldn't be issues for roms here in the current year of two thousand and eighteeeeen~
