He was asking about getting into legal trouble downloading roms. It has nothing to do with potentially malicious files.
Not all of us live in countries that have ISPs dishing out C&D letters for anything and everything.
Public torrents are no more risky than browsing from a legal perspective. Both can be monitored, and if you're looking at the wrong sort of material online you could be potentially targetted by the authorities over terrorism matters (among other things).

We do not store logs of any user activity on the site. So we don't really know what you download - how can anyone else? Furthermore, we recently moved both the site and forums to HTTPS (Secure) connections. This ensures far greater privacy for all our users.
