See back in the day, Nintendo and a bunch of other companies (For example Philips) were under the same roof. Eventually some of these companies split to make their own consoles. However philips still had some rights to certain nintendo characters. Considering how popular these characters were, they figured they could sell systems by advertising games starring these characters. Legally there wasn't really anything nintendo could do.

As for Sonic, while he's not exclusive to Sega machines, he's completely by Sega. They haven't had any "character rights" issues, so if you see sonic, chances are Sega was involved. In fact I don't believe sonic was used on other consoles until after Sega went belly up back in the dreamcast days.

And that's the story.
