Why they are trying to ban the sale is still erroneous since it's a software issue that doesn't affect the system at all. At best, they are used for the WiFi that is easy to fix via a D/L update and streaming videos that should be updated, regardless. It has to be done since it is the right thing to do, but even mentioning the potential ban is just to get gamers' rears in a knot. Seriously guys, move along and don't bother doing vitriolic rants.

Don't understand the doctor mario thing. But Motorrolla already won the court case, its up to the Patent protection agency or whatever it's called cba to re look to see if its a reason to ban the xbox 360 from being sold. Then the president has to sign the papers to make it legal. It's already happened in Germany.

No, because those patents expired over a century ago. Besides, Ford wasn't even the first to create automobiles, so any such general patent would violate the "prior use"/"novelty" requirements used in several nations. If Henry Ford or anyone else had ripped off Selden's designs while his patents were still in effect, he'd have been completely in his rights to shut them down. The key is to permit these people the time to determine how close to the patent the allegedly-infringing work is, and if it is close enough to justify a permanent closure. Until that determination is made, legally, it was and yet remains preferable in the consideration of the Justice Department to end sales of the product pending the final determination rather than to permit sales of a potentially-illegal product to continue.

too bad i'm in canada, i would sell my 360 for double lol, though microsoft would prolly just revise the console (aside from that why is this happening 6 years after launch?)

Judging by Spose's comment, because Microsoft made the mistake of trying to bilk them for money through a lawsuit first. Alternately, because they don't have the money to go digging through the underlying architecture of every product to hit release market to determine how close it hits their patents (instead of, you know, actually making phones and phone software), and thus wouldn't have had reason to suspect Microsoft of ill play until someone pointed out to them a suspicious similarity, particularly if the codec is buried or otherwise hidden within the console's standard functionality.

Can microsoft just purchase said codec?

Probably no, but they can license its use from Motorola. Check the linked story: Motorola's promised to offer a fair deal to Microsoft, likely involving licensing fees that'll be profitable for both sides. The problem is that Microsoft didn't buy or license it originally. Until that deal gets hammered out, though, it'll put the kibosh on future sales.

Microshit wouldnt kill the 360, it wouldnt do them any good, they could just stop production if they wanted it gone

Nope, they sued over something else. Also they used this in W7 phones which might also get stopped being sold for the same reason, it's just ign left it out.

@whomever said mottorolla should be making phones. They are but they are conracted with google now.

That was probably me, though it's not quite an accurate depiction of what I said. It was a half-joke with a point: rather than chasing down people to sue, Motorola has an actual business to run, which is what they prioritize. It's only natural that they wouldn't have devoted the resources to ferreting out every single instance of patent violations proactively from the very moment the infringing product was released.

Yeah it wasn't a diss or anything. Was just added info to that as why they would also go towards Microsoft in a lawsuit. When competitors in the phone market are using the same codec which one created a law suite is expected.

If i owned a company i wouldn't just go out and buy one of every product out there jsut to search it for a damned codec, but when i found out about it and felt like it's necessary i would sue of course.
