But you can't buy the games anywhere anymore, exept on auctions like ebay occasionally.

With the possible exception of the N64 roms (and that is only a possible exception) they cannot be made in a rational court to owe Nintendo anything.

Reason: Nintendo is not currently making ANY money from the majority of these games now anyway because they are not publishing them.
