Default ISP companies 'required' to track all Americans.

    Story

Yeah, required to track everybody in order to catch a few pedophiles.

This means you guys may want to block all EP users with USA IP adresses for a year, at least from certain forum sections and main sites Hosted @ EP, as a courtesy to those of us who are American. Not getting arrested for gaming would be pretty nice.

Also, please share the info. Essentially your whole life is cookie'd and you're being tracked at all times.

Well, they say big brother is always watching. What is this China?

Bear in mind that I am no lawyer, but I'm pretty sure this is a violation of one's first and fourth amendment rights.

Mr. Conyers implies that the data would be used for more than just pedophile investigations, but it wouldn't be too far fetched to hope that there's some provision in the bill that says the info can't be accessed unless it's for said pedophile investigations. Oh, but the authorities wouldn't mind labeling all gamers as pedophiles for the sake of convenience. fml

(anyone know when this shit goes into effect?)

This unconstitutional law (unlawful search and seizure, invasion of privacy, freedom of speech) needs to go through House of Representatives, Senate, and possible Presidential Veto before it would be "Law." Contact your Senators, Representatives, and Whitehouse.gov to tell them that this is unconstitutional and unacceptable!

Two things need to be pointed out here.

First: ISPs will be required to keep records. They are not required to monitor the records and alert the government when they detect people looking at kiddie porn. Or downloading movies. Or whatever.
Second: Using a proxy will not make it so that they do not have any records. The packets still go through your ISP, regardless of how many proxies you're behind. All that proxies will really do is make it seem to the person you're requesting packets from/sending packets to that you're in a different location, IP, whatever. The ISP still knows where you've been.

All of that said, any government agency that wants your records should be legally required to get a warrant for the release of the records. However, with all the Homeland Security bullshit, they could always access them anyways. The only real difference is that now the records will go back a bit further.

Actually ISPs in some European countries are required to retain information for up to 2 years if necessary

I have already confirmed with a Comcast rep that they have not been contacted by the Federal government concerning anything like this, and are only required to share information if a subpoena is given about a potential suspect they are looking into. They don't willingly share information about their customers to the government. I also asked them about filesharing and they also don't keep track nor do they even care about that. They said if they were to crack down on anyone using file sharing for music/movies/games that it would be almost every single person they provide internet service to and they don't have the means, manpower or the desire to do it. Imagine if they had to send letters out to every customer, looking at a cost for paper, ink, and postage, it would be 10s of millions of dollars. So financially they have an incentive to not do this, and even sue the government if they try to push them to do so.
