    Has there been any specific information released yet on what it takes for a given video game to be considered obsolete? The info they gave on the website was a bit sketchy...

    All I can say about this is it's about damn time. Finally they figured out that if you get something for free that is no longer available to buy that you aren't taking anything away from the company because they aren't attempting to sell it. I know most of us have understood this for a long time. I am really happy about this news. Thanks for showing this to the EP community Hipoccolos.

    Interesting, but I'd still like some clarification on this from other sources. What counts and what doesn't?

    Anything containing Nintendo characters - such as Donkey Kong etc, I am sure will not be allowed. Whereas something with characters that are no longer used, may well be fine.

    Well, from what I've been reading, it applies to all defunct systems and the games for said systems. I guess that means that you can download Super Mario Bros. and Donkey Kong to your hearts content, as the games are on a long-since defunct system. Honestly, if that's the case....well, then it ligitimizes a large chunk of what we do. We can freely allow our members to download older games, as long as they are no longer for sale, and that the games are for systems that are no longer on the market. I think that's hella cool, and I think that has the potential of boosting EP alot. I can't wait to see what comes of this.

    I hope what you have said is definately the case. As I firmly believe something like this would eventually be good for the company. It wouldn't do them any harm anyway.

    I don't think you can download say, Super Mario Bros. because, as the article stated, if the company plan to release classic games as a bonus/bundles or something, the copyright still stands. And just Super Mario Bros. is or will be protected 'cause Nintendo will ship that game for the GBA with the Famicom colored GBA. I read that just recently at Gamespot I believe. Same thing with SMB2, SMB3, SMW, YI as they all were released for the GBA and they can still be found every here and there. Now, Super Mario RPG is a different matter.

    Well, the thing is that the wording of the article also states that you can indeed download the games as long as they are not available in retail any longer, and are also on a defunct gaming machine. That totally covers the ORIGINAL SMB games as well as the NES. I'd defy you to find a store that still sells the Mario games NEW along with a BRAND NEW NES. Sure you can purchase the SMB games on the GBA right now, but that is a different story, as they are remakes on a different, and still viable, platform.

    Yeah I kind agree with you on that. I shouldn't have brought up the GBA remakes. But the SMB game I am talking about is the original one. Check Gamespot, they had a news notice about this.

    hmmm, maybe I spoke to soon about them realising something so obvious. I am just confused now. Can't there ever be a ruling on anything that is straight to the point and not full of symantics and leagalese? Maybe this is still a step in the right direction.
